By creating an account or using the Service, you confirm that you have read, understood, and agree to these Terms. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Service

OctoWatch is a software-as-a-service platform that enables security teams to investigate and analyze publicly available GitHub user data, including profile information, follower/following networks, repository activity, and associated metadata. The Service provides tools for network visualization, risk scoring, watchlist management, and team collaboration.

3. Account Registration

To use the Service, you must create an account. You agree to:

• Provide accurate, current, and complete registration information
• Maintain the security of your account credentials, including two-factor authentication
• Promptly notify us of any unauthorized use of your account
• Accept responsibility for all activity that occurs under your account

4. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You shall not:

• Use the Service to harass, stalk, threaten, or intimidate any individual
• Use the Service to violate the privacy or rights of any third party
• Attempt to gain unauthorized access to any part of the Service or its related systems
• Use the Service in any manner that could disable, overburden, damage, or impair the Service

5. Data and Privacy

Our collection and use of personal information is described in our Privacy Policy. The Service processes publicly available data from GitHub's platform. You are responsible for ensuring that your use of the Service and any data obtained through it complies with applicable laws, including data protection regulations in your jurisdiction.

6. Intellectual Property

The Service, including its original content, features, and functionality, is owned by OctoWatch and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the Service for its intended purpose during the term of your subscription.

7. Subscription and Payment

Access to the Service requires a valid subscription. Subscription terms, pricing, and payment terms are specified in your service agreement or order form. Failure to pay applicable fees may result in suspension or termination of your access.

8. Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted or error-free operation. We may perform scheduled maintenance with reasonable notice. We are not liable for any downtime, data loss, or service disruptions.

9. Limitation of Liability

To the maximum extent permitted by law, OctoWatch shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of the Service.

Our total liability for any claims under these Terms shall not exceed the amount you paid for the Service in the twelve (12) months preceding the claim.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the results obtained from the Service will be accurate or reliable.

11. Indemnification

You agree to indemnify, defend, and hold harmless OctoWatch and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in connection with your use of the Service or your violation of these Terms.

12. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, if you breach these Terms. Upon termination, your right to use the Service will cease immediately. Provisions that by their nature should survive termination shall survive, including ownership, warranty disclaimers, indemnity, and limitations of liability.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on the Service and updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the modified Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which OctoWatch operates, without regard to conflict of law provisions.
